The acceptance of the privacy policy of the Service (hereinafter "Privacy Policy"), is a necessary condition for the use of our website.

This Privacy Policy regulates the collection, treatment and use of your personal and non-personal information as a user of the Service, as of the effective date that appears in the header.

To process your personal data, the Service complies with current local and European legislation, as well as its development regulations.

The Service can be used without the need to provide any data, although to contract services through our platform you will need to indicate some personal data. The information (personal or non-personal) collected by the Service may vary based on that.

Personal and non-personal information collected by the Service will come to us in three ways: 1) automatically collected, 2) voluntarily provided to us, and 3) provided by third parties.

2.1.- The automatically collected

This information will consist of:

● That collected through cookies or similar mechanisms stored on your device, always with your consent or in accordance with other legal bases. See our Cookies Policy for more information.

● Data collected through video surveillance systems in order to control and monitor access and company facilities. The personal data collected will be kept for a maximum period of 30 days from its recording. No automated decisions will be made based on said profile.

● The IP from which the connection is made, the type of device used and its characteristics, the version of the operating system, the type of browser, the language, the date, the country, the time of the request, the URL from which you come from, the URL you go to or the mobile network used, among others.

● Data on the use of the Service and possible errors detected during its use.

● In addition, the Service uses Google Analytics, an analytical service provided by Google, Inc. domiciled in the United States with headquarters at 1600 Amphitheater Parkway, Mountain View, California 94043. To provide these services, they use cookies that collect the information, including the user's IP address, which will be transmitted, processed and stored by Google in the terms set out on the website www.google.com. Including the possible transmission of said information to third parties for reasons of legal requirement or when said third parties process the information on behalf of Google.

2.2.- The one you voluntarily provide

This information will consist of:

● That required to create your user profile: for this we collect data when you create or update your account. The data we collect includes your name, email, phone number, username and password, address, date of birth, and banking or payment information (including information related to payment information).  

All data is mandatory.

● That required to complete the provision of the service and carry out the corresponding invoicing: name or corporate name, email, address, telephone, tax and bank details.

If you contract a service on behalf of another person through the platform, you guarantee that you have legitimately obtained the personal information of those other people before providing us with their data.

● The one required to be able to check in online or in person: reservation locator, name and surnames, copy of your DNI, passport or identification document, mobile phone.

● That required to inform and provide complementary services: name, surnames, email and telephone number, medications, allergies or specific health conditions, among others.

● The information, personal or not, that could be contained in the messages sent through the contact or opinion channels established through email or messages, for example your name, telephone number, alias or email.  

● The information, personal or not, that could be contained in the comments and evaluations of the service and the platform, for example your name, email and message.  

● The personal information required to subscribe to the newsletter, such as your email.

● Your photograph, name, nickname or geolocation if you decide to participate in any of our activities on social networks.

2.3.- That provided by third parties

 

This information will consist of:

● That provided by payment systems or credit card processors, such as the time of the reservation.

● That provided by the different providers in relation to the provision of the service, such as, for example, name and time of provision of the service.

● That provided by social networks or similar services.

3.- Rights and purposes

We inform you that the completion of the forms is voluntary. However, if you do not fill in the required fields (marked with a required or asterisk) the use of some functions of the site will not be possible or will be limited.

The personal data that you provide us will be incorporated and will be processed in the files owned by the Service, in order to be able to attend to your requests.

In addition, if you consider that there is a problem with the way in which we are handling your data, you can address your claims to the corresponding data protection authority , the Spanish Data Protection Agency being the one indicated in the case of Spain.

● Manage and update the Service (the legal basis being our legitimate interest in maintaining and keeping the Service up to date and in good condition).

● Address the questions you raise (the legal basis being our legitimate interest in addressing the requests and questions of our users).

● Process the reservations you make (the legal basis being the contract).

● Process payments linked to the reservation of tourist accommodation (the legal basis being the contract).

● Provide the contracted service (the legal basis being the contract).

● Process and complete your entry process as a guest by collecting the data from your national identity document or identification document (the legal basis being the legal obligation regarding the record books and entry parts of the OM INT 1922/2003) .

● Manage and provide complementary services such as rental of buggies or excursions (with your consent being the legal basis).

● Process special data related to allergies, health conditions, medications or other similar data for specialized attention to certain guests (the legal basis being the contractual relationship).

● Manage the online check-in or registration of the guest in the accommodation through the platform (the legal basis being the contract).

● Manage participation in our sweepstakes or contests (the legal basis being your consent).

● Provide and manage the obtaining and use of promotional codes (the legal basis being your consent).

● Guarantee the security of our installations, personnel and clients of the Service (the legal basis being our legitimate interest in guaranteeing the security of the installations and people)

● Send you our newsletter and promotional offers related to the contracted service by email (being the legal basis, depending on the case, the consent or our legitimate interest for direct marketing actions based on the previous contractual relationship, in accordance with art. 21.2 LSSICE).

You can unsubscribe from them from the email received or

by contacting us at info@hotelpatio.com . However, you will not be able to unsubscribe from certain correspondence from us, such as messages regarding the security of your data or the terms and conditions of the Service.

● Maintain the security of the Service, investigate illicit activities, enforce our terms and conditions and help state security forces and bodies in the framework of their eventual investigations (the legal basis being our legitimate interest in guaranteeing and maintaining the security of the Service). Service and its users).

The Service does not use automated decisions, although it can generate basic profiles of users, the legal basis being our legitimate interest for commercial purposes and to provide personalized offers.

Likewise, the Service may use the information of the users in the form of aggregated and anonymous data to show them to third parties. You may also share statistics and demographic information about users and their use of the Service with third parties. But none of this will allow those third parties to personally identify you.

4.1.- In emails, Whatsapp and contact forms

The site's website has TLS encryption that allows the user to send their personal data securely through standard contact forms.

The personal data collected will be subject to automated processing and incorporated into the corresponding files of the activity log and of which the Service is the owner.

We have profiles in some of the main social networks on the Internet, and the Service is responsible for the treatment in relation to the data published in them (for example, photos uploaded by the Service in which people's faces appear).

These data will be processed according to the social network that allows corporate profiles. Therefore, we can inform, when the law does not prohibit it, our followers by any means that the social network allows about their activities or offers, as well as provide a personalized customer service.

In no case do we extract data from social networks, unless the user's consent is expressly and expressly obtained for it.

The applicant authorizes us to analyze the documents they submit, the data obtained in the entrance exams and the information they reveal in the job interview, with the aim of assessing their candidacy and being able, where appropriate, to offer them a position. Being the legal basis of all this the establishment of a pre-contractual relationship.

5.- Data preservation

 

The following indicates how long the data processed by the Service is kept:

● The disaggregated data will be kept without a deletion period.

● Customer data will be kept for the minimum necessary, and may be kept until:

- 5 years, according to art. 1964 of the Civil Code (personal actions without special term).

- 6 years, according to art. 30 of the Commercial Code (accounting books or invoice, for example).

● The data captured through video surveillance systems will be kept for 30 days, unless they are related to serious or very serious criminal or administrative offenses in matters of public security, with an ongoing police investigation or with an open judicial proceeding, according to art. 8 of the Organic Law 4/1997.

● The data of the guests registered during the entry process will be kept for 3 years in accordance with the obligations of Ministerial Order 1922/2003, within the framework of the legal obligation of the registry books and entry parts.

● User data uploaded by the Service to pages and profiles on social networks will be kept from the moment the user offers his consent until he withdraws it.

● The data of the candidates for a job offer, if the candidate is not selected, will be kept for a maximum of two years to include them in future calls, if the candidate authorizes it.

6.- Data shared with third parties

There are third parties that manage part of the Service.

The Service requires them to comply with this Privacy Policy insofar as it is applicable to them and they must also have their own. However, the Service will not be responsible for compliance with said policy.

Under some circumstances, the Service may share, use, preserve, or disclose Personal Information with third parties, on a non-aggregated basis:

● To provide the Service:

Service providers who perform functions on our behalf, such as web hosting, analytics monitoring, or web development. These service providers may collect and have access to information necessary for them to perform their functions, but they are not permitted to share or use the information for any other purpose.
